DOH directive on ban and recall of 9 Samuya products
MEMORANDUM ORDER TO: ALL CONCERNED FROM: FRANCISCO T. DUQUE III, MD, MSc. SUBJECT: RECALL AND BAN OF ALL FOOD PRODUCTS MANUFACTURED BY SAMUYA FOOD MANUFACTURING, INC. DATE: 23 March 2009 Pursuant to Article 10 of Republic Act No. 7394, or the Consumer Act of the Philippines entitled âInjurious, Dangerous, and Unsafe Products, and Unsafe Products" and paraphrasing said provision, whenever in the sound discretion of the Department it may declare a consumer product to be imminently injurious, unsafe, or dangerous, and shall make the appropriate order for its immediate recall, ban or seizure from public sale or distribution. In the light of the recent laboratory report and findings of contamination of the bacteria Salmonella on samples of peanut spread and peanut butter products manufactured by Samuya Food Manufacturing, Inc (Samuya), which were collected in the market and in the establishment itself, and the audit inspection by the Bureau of Food and Drugs done on the above establishment revealed that it has failed and is continuously failing to comply with the Current Good Manufacturing Practices (CGMP) violating Administrative Order No. 153 s. 2004 thereby compromising the good quality and safety of Samuyaâs products, the Department of Health, in the interest of protecting public health and welfare and after due notice to the said manufacturer, suspended the License to Operate of Samuya Food Manufacturing, Inc. The Department likewise declares that the food products identified below, which are manufactured by Samuya at its address at 2451 Lakandula St., Hidalgo Village, Pasay City, to be imminently injurious, unsafe, or dangerous. As such, the same are hereby ordered banned from distribution, sale or offer for sale, or export. No firm company, or whatever entity shall buy, purchase or otherwise acquire said products for whatever reason. 1. Mama Peanut Spread Sweet and Creamy 2. Ludyâs Coco Jam Special 3. Yummy Sweet and Creamy Peanut Spread This ban shall continue to remain in force and effect until such time that the BFAD certifies that the above company is fully complaint to Admnistrative Order No. 153 s 2004 and upon approval of this Department. The manufacturer is directed to immediately recall all food products from the market, coordinate with and report its recall status to the Bureau of Food and Drugs. The Department likewise recalls upon the law enforcement agencies and local government units to coordinate to the Bureau of Food and Drugs, Department of Trade and Industry and Department of Health, including its respective regional and other offices all their efforts in implementing the above directive.
