Violinist John Lesaca files complaint vs. Uber, driver before LTFRB


Violinist John Lesaca on Tuesday filed a complaint against Uber and driver Anie Agbayani before the Land Transportation Franchising and Regulatory Board (LTFRB).

Lesaca earlier took to Facebook recounting the supposedly rude behavior and reckless driving his wife and daughter had to endure while in a car being driven by Agbayani on their way to a hospital.

In a joint affidavit of complaint, Lesaca's daughter Kristine Maria Lesaca-Saludez and her mother Victoria Conception Sison said they are both cancer patients receiving treatment at The Medical City in Pasig City.

Lesaca was unable to accompany them on June 30, prompting his wife and daughter to book an Uber ride.
 


Agbayni caused undue stress to his daughter and her mother, who both have cancer, when she made them walk the rest of the way to their destination under the rain - so she could take a shortcut home, Lesaca noted.

Agbayani supposedly drove recklessly, kept changing lanes, and counter-flowed, which "put three persons' lives in danger," according to the complainants.

"Ms. Anie Agbayani's unprofessional and reckless driving made us nauseated and dizzy and made us step on imaginary brakes, and seeing how badly stressed out we were due to the bad driving, we tried to calm each other and amuse each other with other things," they added.

The complainants further claimed that Agbayani was munching on chips while driving that she "did not hold the steering wheel properly."

Uber earlier said that Agbayani was been suspended from the ride-booking platform.

The LTFRB issued a July 7 show cause order for Uber System Inc. and Agbayani to attend a hearing on the matter at 9 a.m. on July 18.


Lesaca is "looking forward" to meeting Uber and Agbayani.


"Anie should show that she is sincere in her remorse and she has to show that she is prepared to atone for it. You know, I don't want to play God here and I don't want to say that this is the best form of punishment, for example, is 50 lashes, you know. Hindi ganon. I'll let the courts decide on that," Lesaca said.


Lawyer Dot Gancayco, legal counsel of Lesaca and his family, said that the Uber driver did not only commit a breach of contract for failing to drop off the passengers at their destination, she also violated several traffic laws.


The lawyer said they are also planning to file a civil case against Uber and its driver for moral damages.


"It's a combination of so many traffic violations. And of course yung damage sa dalawang pasyente. Nagkaroon sila ng mental anxiety, na-stress sila, and we are still thinking about what charges we are going to file, but definitely we are pushing through with this," Gancayco said. — VDS/KVD, GMA News
