Krisel Mallari: School-issued certificate 'sarcastic, non-compliant'

Krisel Mallari, the salutatorian who delivered a scathing speech against her school during graduation, is not satisfied with the certificate of good moral character issued to her by the Santo Niño Parochial School (SNPS).
In a manifestation, Mallari said the school seemed "sarcastic" in issuing a "qualified" certificate that detailed the status of the cases filed with the appeals court and the Quezon City Regional Trial Court, something which she said was no longer necessary.
"A mere perusal of the so-called Certificate of Good Moral Character would reveal that the same is not in faithful compliance with this Honorable Court's directive," read the manifestation.
Mallari was referring to the CA Second Division's directive last January 29 for the school to issue a certificate of good moral character, with the court insisting Mallari should not be prevented from pursuing college for mere transgressions in school.
"There was no need for the issued certificate to state 'the Regional Trial Court, after hearing both sides, denied a similar application for injunctive relief,' because this was precisely the order overturned by this Honorable Court through the petitioner's petition for certiorari and mandamus," read the manifestation.
Mallari's camp added that there was no need to mention in the certificate that the CA's writ of preliminary mandatory injunction violated the school's right to due process for being issued "ex parte" or without getting their side first.
"The respondents, through Principal [Herminida] Catud, did not content themselves with merely issuing a qualified certification, but one which blatantly questions the wisdom of this Honorable Court and attacks its integrity and credibility, in a manner so contemptuous in character," the student's camp added.
Mallari said by quoting the dispositive portion of the CA's July 29 resolution, Principal Catud "gave the appearance of being sarcastic in her certification - an affront against the authority of this Honorable Court."
Mallari's camp said the school was being "stubborn" and "made a mockery out of the lawful process" of the CA when it issued the "qualified" certificate that was meant to still "block any future petitioner Krisel has" with the University of Santo Tomas, where she had applied and was accepted under its accountancy program.
"No doubt, the respondents, through Principal Catud, displayed nothing less than their propensity to circumvent and resist any ruling to their disadvantage," read the manifestation.
Mallari said by saying it was issuing the certificate "with reservation," "under protest," and "with full intent to assail the legality, validity and authority of the Honorable Court of Appeals' Resolution," the school was hardly complying the CA order.
In her manifestation, through the Public Attorney's Office (PAO), Mallari once again insisted of having officials of the SNPS arrested and cited in contempt.
Mallari said the school had implied that apart from the certificate issued to her, there is still a valid and unqualified Certificate of Good Moral Character available, but its release is put on hold.
"Thus, petitioner Krisel continues to suffer in the hands of the respondents - who appear to be vindictive and cruel guardians of their students," read the manifestation.
The PAO said Mallari secured the certificate from the school on Thursday last week, the same day the CA had ordered the SNPC to explain its defiance of an earlier order to issue the certificate.
The PAO said Mallari submitted the certificate to UST on Friday, July 3, where she was informed by the dean that the matter shall first be taken up by the university council on August 4.
"Hence, there is still uncertainty in her future with UST; although the latter came to know of the fact that classes in the university will actually start on 10 August 2015 (3 August 2015 being the Freshmen Orientation)," read the manifestation. —ALG, GMA News
