SolGen eyes filing of Comelec appeal on BSKE law on or before Oct. 11, 2023


The Office of Solicitor General is eyeing to file, on or before October 11, the Commission on Elections' motion for partial reconsideration on the Supreme Court decision on the law that postponed the barangay and Sangguniang Kabataan elections (BSKE).

The SC declared unconstitutional the law that postponed the BSKE from the initial schedule of December 5, 2022, to the last Monday of October 2023.

It also ruled that the succeeding BSKE shall be held on the first Monday of December 2025 and every three years thereafter. Comelec said it plans to appeal this portion of the SC decision.

“We received the Comelec’s letter requesting us to file a motion for partial reconsideration of the SC decision in the BSKE case. We will file this motion on or before October 11, as we officially received a copy of the SC decision last September 26,” Solicitor General Menardo Guevarra said in a text message.

Comelec Chairman George Garcia said the poll body will appeal the particular provision as it believes the three-year terms of office for barangay and SK officials should be respected.

Garcia also said it would be difficult to hold both the midterm polls and the BSKE in 2025. — BM, GMA Integrated News
