Casiño seeks motorcycle taxi, delivery rider regularization


Makabayan senatorial candidate Teddy Casiño announced on Tuesday his support for legislation granting motorcycle taxi and delivery riders the status of regular employees.

“It is high time that we enact a law to accord them the rights and benefits of ordinary employees... I am pushing for a Motorcycle Taxi and Delivery Riders Rights and Welfare Act,” Casiño said in a statement.

He explained that the primary aim of the proposed measure is to formally recognize the employer-employee relationship between riders and the operators of ride-hailing and delivery platforms such as Grab, Angkas, Move It, Lalamove, and foodpanda.

Casiño also cited a Supreme Court ruling that recognized delivery riders as regular employees. In that decision, the Court applied a two-tiered test to determine the existence of an employer-employee relationship: the four-fold test and the economic dependence test.

Under the four-fold test, four criteria are considered: (a) the employer’s selection and engagement of the worker; (b) payment of wages; (c) the power to dismiss; and (d) the power to control the worker’s conduct—with control being the most critical factor. https://www.gmanetwork.com/news/money/companies/858196/sc-to-lazada-reinstate-dismissed-riders/story/

If passed, Casiño’s proposed bill would entitle riders to minimum wage and mandatory contributions to the Social Security System (SSS), PhilHealth, and Pag-IBIG.

“Titiyakin din ang kanilang karapatang mag-organisa ng unyon at mag-negotiate ng collective bargaining agreement," he added. "Kasama rito ang pagtiyak sa due process bago ang suspension o deactivation nila sa app.”
