Maguindanao isinailalim ni Arroyo sa batas militar

Sa unang pagkakataon mula nang ideklara ni dating Pangulong Fernand Marcos ang martial law sa buong bansa noong 1972, muli itong idineklara ni Pangulong Gloria Macapagal Arroyo nitong Sabado ng umaga sa buong lalawigan ng Maguindanao. Ang pagsasailalim ni Arroyo sa Maguindanao sa ilalim ng kontrol ng militar ay bahagi pa rin umano ng ginagawang paghahanap ng katarungan sa 57 sibilyan – kabilang ang 30 mamamahayag – na pinaslang sa Ampatuan, Maguindanao noong Nobyembre 23. Nitong Biyernes ng gabi nilagdaan ni Arroyo ang Proclamation No. 1959 na nagdedeklara ng martial law sa Maguindanao sa loob ng dalawang buwan, ngunit nito lamang Sabado ng umaga inihayag sa publiko ang kautusan. Mayroon dalawang araw ang Kongreso upang talakayin ang idineklarang batas militar kung aaprubahan o ibabasura ng mga mambabatas ang nabanggit na deklarasyon alinsunod sa nakasaad sa Konstitusyon. Sa pulong balitaan sa Malacanang nitong Sabado, sinabi ni Executive Secretary Eduardo Ermita na suspendido ang writ of habeas corpus sa lalawigan maliban sa ilang piling lugar. Kaugnay ito sa gagawing pag-aresto sa mga hinihinalang may kinalaman sa naganap na masaker sa lalawigan. "We are confident that this one is covered by the Constitution," pagtiyak ni Ermita. "The condition of peace and order in the province of Maguindanao has deteriorated to the extent that local judicial systems and other government mechanisms are not functioning and thus endangering public safety." Idinagdag ni Press Secretary Cerge Remonde na hindi na makausad ang hustisya sa lalawigan dahil sarado na ang ilang tanggapan ng gobyerno at hindi na pumapasok ang mga opisyal, maging ang mga hukom. “The judicial process in the province is being hampered as no judges will take the case, no judges will pursue the proper search warrants, or warrant of arrests," pahayag niya. Pinapangambahan din ang pagsiklab ng kaguluhan dahil sa mga namataang armadong grupo sa iba’-ibang bahagi ng Maguindanao na pinapaniwalaang tagasuporta ng mga Ampatuan. Pangunahing suspek sa masaker si Datu Unsay mayor Andal Ampatuan Jr na nakapiit ngayon sa National Bureau of Investigation. Ilan pang miyembro ng pamilya ang “inimbitahan" ng mga awtoridad para tanungin sa nangyaring krimen. Nitong Sabado, napag-alaman na nasa kostudiya na rin ng pamahalaan ang ama ni Andal Jr na si Maguindanao Gov. Andal Ampatuan Sr. at kapatid niyang si Governor Zaldy Ampatuan ng Autonomous Region for Muslim Mindanao (ARMM).

Ayon sa nakuhang impormasyon sa isang source, magsisilbing military governor sa Maguindanao si Armed Forces Eastern Mindanao commander Lt. Gen. Raymundo Ferrer kasunod ng gagawing 'pag-imbita' kay Ampatuan Sr. "This from usually reliable insider, martial law to be declared in Maguindanao tomorrow. Lt. Gen. Ferrer will be Military Governor. Ampatuans expected to be arrested," nakasaad sa text message ng source. Nauna na ring inihayag ni AFP spokesman Lt. Col. Romeo Brawner sa GMANews.TV nitong Biyernes na hindi pa kailangan ang pagdedeklara ng martial law. Ipinatupad ang “state of emergency" sa Maguindanao noong nakaraang linggo. "There is no need for the declaration of martial law in the area of Maguindanao or elsewhere in the country because the AFP and the Philippine National Police are on top of the situation," pahayag ni Brawner. Maging ang mga human rights lawyers ay naniniwala na hindi na kailangan ipatupad ang batas militar para dakpin ang mga may kinalaman sa masaker. "There was already a state of emergency. Why did they need a declaration of martial law?" ayon kay Theodore Te, kasapi ng Free Legal Assistance Group (FLAG). “There's no reason for it, unless they're not revealing everything yet." "The talk among some lawyers is that this could be an experiment or a testing ground for declaring martial law in other provinces to consolidate for unpopular candidates," idinagdag niya. "She (President Arroyo) must clearly demonstrate why martial law needs to be declared. The proclamation of Martial Law can be used as a means to gain unfair advantage in the upcoming elections or as an excuse to declare a failure of elections contrary to the people’s will," nakasaad sa Facebook page ni Leonen. Banta sa Maguindanao Sa pulong balitaan sa Malacanang, sinabi ni Armed Forces Chief of Staff Gen. Victor Ibrado na may banta na posibleng magsanib ng puwersa ang mga suspek sa Maguindanao massacre at mga armadong tagasuporta ng mga Ampatuan kaya nila inirekomenda ang martial law sa lalawigan. “We received reports that they had plans to undertake hostile action if ever the government officials, the Ampatuans particularly, were taken into custody. We felt this is a very imminent threat so we recommended for this proclamation," ayon sa opisyal ng militar. “With the connection of the reported armed groups that may provide support for those suspected of being involved and manifested by the fact there are many high powered firearms recovered in the general area, the elements of rebellion are present and hence the basis for the declaration of a proclamation declaring martial law and suspension of habeas corpus is established," idinagdag ni Ermita.
