Subpoena ng Kamara vs Ombudsman officials, ipinadala na

MANILA – Naipadala na sa Office of the Ombudsman nitong Biyernes ang subpoena para kay Ombudsman Ma. Merceditas Gutierrez at sa mga opisyal nito, para obligahin silang dumalo sa pagdinig ng Kamara de Representantes. “The subpoenas ad testificandum will be served today (Friday) to the Ombudsman and the prosecutors to compel them to attend the continuing hearing of the justice committee on Garcia plea bargaining agreement on February 1, Tuesday," pahayag sa media ni Iloilo Rep. Niel Tupas Jr., chairman ng House committee on justice. Ang subpoena ay inaprubahan ng komite ni Tupas mula sa mosyon ni Bayan Muna party-list Rep. Teodoro Casino, nang hindi sumipot ang grupo ni Gutierrez sa pagdinig tungkol sa plea bargain agreement ng dating military general na si Oscar Garcia noong Martes. Hindi rin nagustuhan ng mga mambabatas na kasapi ng komite ang laman ng ipinadalang sulat ni Gutierrez na nagpapaliwanag kung bakit hindi siya sumipot sa pagdinig. Kabilang sa mga idinahilan ni Gutierrez ang kawalan umano ng hurisdiksiyon ng komite sa naturang usapin sa kaso ni Garcia. Bukod pa rito, nakabinbin pa umano sa Second Division ng Sandiganbayan ang usapin tungkol sa plea bargain agreement ng kontrobersiyal na dating heneral . “Third, since the apparent purpose of the inquiry, as reflected in the media and in the Minutes attached to the invitations, is to determine the validity of the plea bargaining agreement and the possible liability of those involved in or behind said agreement, should it be illegal, the inquiry may not be in aid of legislation and not within the legitimate province of the legislature," nakasaad sa sulat ni Gutierrez na binasa ni Atty. Narcisa H. Guevarra, committee secretary. Kinumpirma naman ni Speaker Feliciano “Sonny" Belmonte Jr., na pinirmahan na niya ang subpoena para matiyak na dadalo sa susunod na pagdinig ng Justice committee sina Gutierrez. Bukod kay Gutierrez, kasama sa mga ipatatawag sina Overall Deputy Ombudsman Orlando Casimiro, Chief Special Prosecutor Wendel Barreras-Sulit, Special Prosecutor III Jose Balmeo, Special Prosecutor II Joseph Capistrano, Deputy Special Prosecutor Jesus Micael at Deputy Special Prosecutor Robert Kallos. Nitong Huwebes, lumitaw sa inilabas na listahan ng Judicial Records Division ng Sandiganbayan na nakapagtala lamang ng 12 porsiyentong conviction rate ang Office of the Special Prosecutor ng Ombudsman noong 2010. Ito ay katumbas ng 30 conviction mula sa 247 kaso na isinampa nito sa Sandiganbayan noong 2010. Mas mataas lamang ito ng dalawang porsiyento sa conviction rate noong 2009 na 12 percent. Sa naturang panahon, nagawang maipanalo ng Ombudsman ang 36 sa kabuuang 357 kaso na inihain nila sa anti-graft court. - GMANews.TV
