SC ibibigay sa Malacanang at Kongreso ang mga panukala sa summit on extrajudicial killings

Ibibigay ng Korte Suprema sa Malacañang at Kongreso ang mga rekomendasyon na nabuo sa dalawang araw na pagpupulong kaugnay ng tinatawag na extrajudicial killings upang magawan ang mga ito ng karampatang aksyon. Sinabi ni Jose Midas Marquez, tagapagsalita ng Korte Suprema, na ang mga panukala kung paano malulutas ang sunud-sunod na kaso ng pagpatay sa mga progresibong mamamayan, kasama na ang mga mamamahayag, ay aayusin upang ipadala sa Office of the President ang mga naaayon dito para sa akmang hakbangin. Sa ilalim ng writ of Amparo, ayon kay Te, maaaring utusan ng Korte ang military o ang pulis na patuloy na hanapin ang nawawala. Ang ilan pa sa mga rekomendasyon sa lumabas sa pagpupulong para sa Korte Suprema ay ang mga sumusunod: • Discard or at least circumscribe the doctrine of absolute immunity of the President. • Adopt the doctrine of command responsibility as enunciated in the Rome statute. The Rome treaty is a stricter interpretation of the principle of command responsibility because it assumes that the superior "should have known" illegal acts perpetrated by his or her subordinates, as against the older test that the superior only “had reason to know." • Exercise its rule-making power as defined in Art. VIII, Sec. 5 (5) of the Constitution. Recommendations for the Executive Branch/ the President: • Certify [for the Senate to ratify] the Rome treaty, provided that constitutional rights are protected. • Submit to the Senate for ratification the Convention and Protocol on Enforced Disappearances and the additional protocol to the Geneva Convention for the Protection of Victims of International Armed Conflicts. • Submit for the Senate's ratification the Protocol to the Convention Against Torture. • Conduct a comprehensive dialogue with all stakeholders. • Increase the budget for the Witness Protection Program. • Establish or improve a reward system for informers. Recommendations for the Legislative Branch: • Propose legislation to enforce command responsibility. • Establish a local definition of extrajudicial killings and impose corresponding penalties and punishment. Recommendations for the AFP and National Police: • Be more cognizant of the doctrine of command responsibility, and be cooperative in investigations. • Train all ranks (not just mid- to high-ranking officers) on principles of human rights, and make the program part of initial trainings and orientation of every member of the AFP and the PNP. • Improve its forensic capability. - GMANews.TV
