SC sa Comelec: Mga makinang bibilang ng mga boto, dapat maglabas ng resibo

Inatasan ng Korte Suprema ang Commission on Elections na paganahin ang receipt-printing feature sa mga vote counting machines (VCMs) na gagamitin sa pagbilang ng mga boto sa darating na halalan sa Mayo.

Sa press briefing nitong Martes, sinabi ni SC spokesman Theodore Te, na "unanimous" (14-0),  ang naging boto ng mga mahistrado sa petisyon ni dating Senador Richard Gordon, na atasan ang Comelec na paganahin ang voter verified paper audit trail.

Sa mga mahistrado, tanging si Associate Justice Arturo Brion ang hindi nakaboto dahil nakabakasyon ito.

"The Comelec is ordered to enable the vote verification feature of the vote counting machines, which prints voter's choices without prejudice to the issuance of guidelines to regulate the release and disposal of the issued receipts to ensure clean, honest, and orderly elections," pahayag ni Te.

Nakasaad din sa direktiba ng SC na ilalagay sa isang ballot box ang mga ilalabas na resibo matapos masuri ng botante kung tama ang kaniyang mga ibinoto. Hindi maaaring ilabas ng presinto ng botohan ang mga resibo.

Una rito, nakasaad sa 24-pahinang petisyon ni Gordon, kandidatong senador, na dapat ipatupad ng Comelec ang Section 7(e) ng Republic Act No. 9369 o ang Automated Elections System (AES) Law,  na nagsasaad na ang VVPAT isa sa mga mahalagang bahagi at sistema sa automated elections.

Ikinatuwa naman ng kampo ni PDP-Laban presidential candidate Davao City Mayor Rodrigo Duterte, ang naturang desisyon ng SC.

“This would allay fears of the people that their votes will not be counted properly,” ayon kay Peter Laviña, spokesperson ni Duterte.

Kabilang ang PDP-Laban sa mga sumusuporta sa mga panawagan na paganahin ng Comelec ang sistema sa paglabas ng resibo ang VCMs para matiyak na tama ang mga botong babasahin ng makina.

Una rito, idinahilan ng Comelec na hindi nila pinagana ang VVPAT feature ng mga makina dahil sa makadadagdag ito ng oras sa botohan at maaaring magamit sa pamimili ng boto.

May epekto sa paghahanda

Dahil sa naging desisyon ng SC, sinabi ni Comelec chairman Andres Bautista na makaaapekto ito sa kanilang paghahanda sa darating na Mayo.

"In sum, there is no question that this decision materially impacts our preparations for the 2016 elections and we will need to revisit our timelines," ayon kay Bautista.

"It bears emphasizing that when we made the decision to enable the onscreen verification as opposed to printing the receipt, we were making this not just in consideration of legal issues, but also the practical the operational and technical concerns that one needs to consider when managing an elections," dagdag niya.

Kakailanganin din umano nila na muling sanayin ang first batch ng mahigit 277,000 guro na magsisilbing kasapi ng Board of Election Inspectors (BEIs) sa eleksyon. Bukod pa rito ang pag-amyenda sa ipalalabas nilang general instructions.

"We are almost halfway done [with the training] and now it looks like we have to call them back and re-train those who have already been certified," paliwanag ni Bautista. -- FRJ, GMA News
