2 senador nagbabala ng constitutional crisis sa EO 464

Posibleng magbunsod ng constitutional crisis ang plano ng Malacanang na igiit ang Executive Order No. 464 upang hadlangan ang panibagong imbestigasyon ng Senado sa "Hello Garci" tapes. Ito ang babala nina Senador Francis Escudero at Benigno "Noynoy" Aquino III nitong Huwebes bilang tugon sa pahayag ni Executive Secretary Eduardo Ermita noong Miyerkules na gagamiting ng Palasyo ang EO 464 sa oras na imbitahan sa imbestigasyon ng Senado. "The Supreme Court has already ruled that EO 464 is partially constitutional and unconstitutional. What the court said was constitutional was the provisions on the Question Hour but the expansion of the executive privilege was the one declared unconstitutional," paliwanag Aquino. Ipinagpaliban ng Senado ang nakatakdang imbestigasyon sa Hello Garci sa susunod na linggo hangga't hindi nakapagpapalabas ng rekomendasyon ang Rules Committee. Ibinigay sa Rules Committee ang trabaho na alamin ang mga legal na problema na maaaring umusbong kapag sinimulan ang imbestigasyon particular sa usapin ng wiretapping. Ngunit iginiit ni Aquino na dapat sundin ng Malacanang ang desisyon ng Korte Suprema sa EO 464 upang maiwasan ang constitutional crisis. Inihayag naman ni Escudero na hindi maiiwasan ang constitutional crisis kung patuloy na magkakaroon ng magkaibang interpretasyon sa batas ang Malacanang at Senado. "In this case the Senate believes we could summon executive officials (to the hearing) and that EO 464 can't be invoked to prevent this. On the other hand, the Executive believes they can rightfully invoke it," aniya. "In this case, it would be the Supreme Court that will determine, if necessary, what should be done anytime such situation crops up," dagdag ni Escudero. - Fidel Jimenez, GMANews.TV
