'Endo,' bawal na sa kautusang inilabas ng DOLE

Naglabas na ng kautusan si Labor and Employment (DOLE) Secretary Silvestre Bello III nitong Huwebes na nagbabawal sa mga maiigsi at paulit-ulit na kontrata sa pagkuha ng mga empleyado tulad sa tinatawag na "endo" o end contract agreement.

Sa pagpapalabas ng Department Order 174, Series of 2017, partikular na ginawang halimbawa ni Bello ang kontrata na hindi pinapaabot ng anim na buwan ang serbisyo ng empleyado para hindi ito maging regular sa trabaho.

"Ito yung endo – hire ka for five months. After another five months, hire ka ulit through a contractor," ayon sa opisyal.

"We have a commitment from management na wala na ito. Pero, alam mo, we still have to be very careful, kasi ang dami pa rin naming nalalaman na endo," dagdag niya.

Kabilang sa mga ipinagbabawal sa ilalim ng Department Order 174 ay ang:

• Labor-only contracting
• Principal farming out work to a "Cabo"
• Contracting out jobs or work through in-house agency
• Contracting out jobs or work through in-house cooperative (which merely supplies workers to the principal)
• Contracting out job by reason of strike or lockout whether actual or imminent
• Contracting out job or work by union members (to interfere with, restrain or coerce employees in the exercise of their rights to self-organization)
• Requiring contractor's or subcontractor's employees to perform functions currently being performed by regular employees of the principal
• Requiring contractor's or subcontractor's employees to sign, as precondition to employment or continued employment, an antedated resignation letter, a blank payroll, or a quitclaim (documents) among others
• Repeated hiring by contractor or subcontractor of employees for short duration
• Requiring employees under contracting or subcontracting arrangement to sign contract fixing the period of employment to a term shorter than the term of Service Agreement
• Other practices, schemes, or employment arrangements designed to circumvent the right of workers to security of tenure

Una nang ipinangako ni Bello na ibabasura nito ang department order na pinupuna ng mga kritiko na naging dahilan kaya nagkaroon ng "endo" na ginagamit ng ilang employer.

Nitong Huwebes, nangako rin ang kalihim na mahigpit nilang ipatutupad ang bagong kautusan, pati na ang lahat ng batas at patakaran para pangalagaan ang karapatan ng mga manggagawa.

Kabilang ang pagwawakas ng "endo" sa mga ipinangako ni Pangulong Rodrigo Duterte noong panahon ng kampanya.

Nagbabala pa ang pangulo sa mga negosyante na nagpapatupad "endo" na sundin ang batas kahit hindi isailim sa audit ng DOLE para hindi sila mapatawan ng parusa.

Sinabi ni Bello na magdadagdag sila ng mga tauhan para masubaybayan ang implementasyon ng bago niyang kautusan.

Pero sa kabila ng bagong kautusan na inilabas ni Bello, isang grupo pa rin ng mga manggagawa ang nanawagan kay Duterte na alisin sa puwesto ang kalihim.

Sa isang pahayag, sinabi ng Associated Labor Unions-Trade Union Congress of the Philippines (ALU-TUCP),  na ang kautusan ni Bello ay magpapanatili naman umano sa "contractualization" sa bansa, isang dahilan pa rin kaya hindi nareregular sa trabaho ang isang manggagawa.

"By issuing a DO that further perpetuates the abhorred contractualization in the country, Mr. Bello has violated the direct policy pronouncement of President Duterte who expressed time and again that all forms of contractualization including 'endo' and agency hiring must stop," ani Alan Tanjusay, spokesperson of ALU-TUCP. -- FRJ, GMA News
