Naninindigan si Justice Secretary Menardo Guevarra sa nauna niyang posisyon na walang "immunity from suit" ang bise presidente ng bansa. Pero paglilinaw ng kalihim, hindi ito reaksiyon sa sinabi ni Pangulong Rodrigo Duterte na baka tumakbo siyang bise presidente sa Eleksyon 2022 para makaiwas sa mga asunto.

Sa mensaheng ipinadala ni Guevarra sa mga mamamahayag, binalikan ng kalihim ang kaniyang sinabi noong 2019 na walang "immunity" sa kaso si Vice President Leni Robredo, na kabilang sa mga respondent noon kaugnay sa reklamo tungkol sa tangka umanong pagpapatalsik kay Duterte sa puwesto.

Noong nakaraang taon, ibinasura ng DOJ ang naturang reklamo laban kay Robredo dahil sa kakulangan ng ebidensiya.

“When Vice President [Leni] Robredo was included in sedition charges in 2019 in connection with alias Bikoy’s allegations, I remarked that the VP was not immune from suit under the present Constitution. My opinion on the matter has not changed,” ayon kay Guevarra.

Pero nilinaw ni Guevarra na hindi ito tugon sa naging pahayag ni Duterte kaugnay sa posibilidad na tumakbo siyang [Duterte] bise presidente sa 2022 elections para makaiwas sa mga posibleng kaso na kaniyang kakaharapin kapag natapos na ang termino niya bilang pangulo ng bansa.

“Please note that I am not commenting on PRRD’s [President Duterte’s] recent statement about his belief on the VP’s immunity from suit, which I consider as part of a political statement rather than a legal conclusion on his part,” paglilinaw ng kalihim.

Paniwala naman ng Malacañang, ang pahayag ni Duterte ay, “opportunity to challenge jurisprudence.”

Dati nang sinasabi ng Korte Suprema na mayroong "immune from suit" ang mga nakaupong presidente kahit hindi ito malinaw na nakasaad sa Saligang Batas.

“A Vice President has no immunity from suit. That is rewriting the Constitution, the law and even jurisprudence,” ayon kay National Union of Peoples’ Lawyers president Edre Olalia.

“So the claim is either a Freudian slip or betrays premeditated naughty intentions for now-he-is-not-running-now-he-is-running plans for Vice President. So either way, he can try to hide but he cannot run,” dagdag niya. — FRJ, GMA News
