Naghain ng bagong "Defence Notification" ang kampo ni dating Pangulong Rodrigo Duterte sa Pre-Trial Chamber ng International Criminal Court (ICC) para sa “interim release" nito.

Sa dokumentong isinumite sa Pre-Trial Chamber 1 na may petsang Setyembre 16, 2025, sinabi ng kampo ni Duterte na nais nilang maghain ng karagdagang kondisyon kaugnay ng pansamantalang paglaya ng dating pangulo.

"The Defence feels it appropriate to observe that the issue of fitness was raised prior to the initial appearance, and two requests were made, a considerable time ago, for status conferences to regulate litigation of the matter. The Prosecution, which wishes to detain Mr. Duterte, opposed these status conferences that could have regulated the timely [REDACTED]," saad ng kampo ni Duterte.

Dati nang iginiit ni Atty. Nicholas Kaufman, abogado ni Duterte, na hindi na umano maayos ang kalagayan ng alaala ng kaniyang kliyente. Hindi na umano matandaan ng dating pangulo ang mga kaganapan, mga lugar, petsa, o maging ang mga malalapit nitong kaanak.

Dahil dito, pansamantalang ipinagpaliban ng ICC ang nakatakdang pagdinig para sa pagbasa ng sakdal laban kay Duterte sa Setyembre 23, kasunod ng paggiit ng kanyang kampo na “not fit to stand trial” ang dating pangulo.

Umaasa ngayon ang kaniyang kampo na papayagan ng Pre-Trial Chamber ang kaniyang pansamantalang paglaya habang walang pagdinig.

"Although the Pre-Trial Chamber has ruled that there should be only a short adjournment of the proceedings, the hearing on the confirmation of charges has effectively been postponed sine diem... Considering the aforementioned, the Defence wishes to proffer a further condition in respect of interim release; namely, the provision of [REDACTED] at the discretion of the Pre-Trial Chamber, which will [REDACTED]. This [REDACTED], which would be a condition for release, would remain under the exclusive supervision of the Pre-Trial Chamber, and would be [REDACTED]," saad ng kampo ni Duterte.

"Mr. Duterte should not remain in detention while proceedings on fitness – now expected to take no less than [REDACTED] at a minimum – are underway. Administrative delay, occasioned by [REDACTED], cannot justify the abrogation of liberty. Provisional release should be ordered as soon as continuing detention ceases to be reasonable," ayon pa sa abogado.

Dagdag pa ng kampo ni Duterte, "the receiving State identified by the Defence as willing to host Mr Duterte will be required, as a condition for release, to facilitate [REDACTED] by the Court."

"Mr Duterte’s release while litigation on fitness is underway would ensure a proper balance between a suspect’s rights under the Statute while respecting the efficiency and integrity of the proceedings," pahayag pa nito].

Maliban sa Defence Notification, naghain din si Kaufman ng dokumentong na "Defence First Communication of Disclosure of Evidence on 5 September 2025."

"On 5 September 2025, the Defence disclosed to the Office of the Prosecutor and the Office of Public Counsel for Victims 29 items. On 11 September 2025, the Defence disclosed to the Office of the Prosecutor and the Office of Public Counsel for Victims one item," saad nito.

Sa kabila ng pahayag ni Kaufman tungkol sa kalagayan ng alaala ni Duterte, sinabi ng anak ng dating pangulo na si Vice President Sara Duterte, na “okay” ang kaniyang ama nang makausap niya ito sa telepono kamakailan.

“Nag-usap kami [ni former President Duterte] about politics, nag-usap kami about flood control, nag-usap kami about love life niya,” saad ng bise presidente.

Kasalukuyang nakakulong si Duterte sa Hague Penitentiary Institution o Scheveningen Prison dahil sa kasong crimes against humanity kaugnay sa naging kampanya ng kaniyang administrasyon laban sa ilegal na droga, na ayon sa datos ng pamahalaan ay ikinamatay ng mahigit 6,000 katao sa mga operasyon ng pulisya.

Ngunit ayon sa mga human rights organizations, maaaring umabot sa 30,000 ang nasawi sa war on drugs campaign ni Duterte, kabilang ang mga hindi naitalang insidente.—FRJ GMA Integrated News
