Sa botong 11-70, ibinasura ng House Committee on Legislative Franchises nitong Biyernes na bigyan ng panibagong prangkisa para makapag-operate ang ABS-CBN Broadcasting Corporation.
Sa botohan, 11 kongresista ang tumutol habang 70 naman ang pumanig sa inihandang resolusyon ng Technical Working Group na nagrekomendang ibasura ang aplikasyon ng ABS-CBN para sa panibagong 25 taon na prangkisa.
Dalawang kongresista rin ang nag-inhibit sa botohan, at isa ang nag-abstain.
Base sa nakasaad sa ulat ng TWG, nilabag umano ng ABS-CBN ang luma nilang prangkisa dahil sa mga sumusunod: ang dati nilang chairman na si Eugenio Lopez III ay parehong Filipino at American citizen, ang Philippine Depositary Receipts ay pabor sa mga dayuhan, inappropriate program content, pakikialam sa pulitika, tax avoidance schemes; hindi patas na labor practices, at iba pa.
Idinagdag ng TWG na hindi maaaring gamitin ng ABS-CBN ang usapin ng freedom of the press para sa kanilang aplikasyon ng prangkisa.
“It is what it is — a denial of a privilege granted by the State because the applicant was seen as undeserving of the grant of a legislative franchise. By no means can this franchise application be related to press freedom. If it were so, then all applicants for legislative franchises covering mass media could simply claim such freedom and force the hand of this Committee each time,” ayon sa resolusyon.
“Such a scenario is totally inconsistent with the nature of legislative franchises as a mere privilege and never a matter of right. Wherefore, in view of the foregoing, the technical working group respectfully recommends the DENIAL of the franchise application of ABS CBN Corporation,” dagdag nito.
Ang TWG ay kinabibilangan nina Deputy Speaker Pablo John Garcia, Representatives XJ Romualdo (Camiguin) at si Stella Quimbo (Marikina), na nag-dissent o 'di sumang-ayon sa rekomendasyon.--FRJ, GMA News
