Nahaharap ang dating kalihim ng Department of Budget and Management (DBM) na si Amenah Pangandaman sa mga reklamong may kaugnayan sa paglilipat ng P60 bilyong sobrang pondo ng Philippine Health Insurance Corporation (PhilHealth) at P107 bilyong pondo ng Philippine Deposit Insurance Corporation (PDIC) sa pambansang kaban ng bayan, na umano’y labag sa batas.

Inihain ni Dr. Tony Leachon ang mga reklamo sa ilalim ng supplemental complaint na isinampa sa Office of the Ombudsman nitong Huwebes para sa umano’y technical malversation, graft, at iba pang administratibong kaso laban kay Pangandaman.

“Complainant respectfully states that Respondent Amenah Pangandaman, former Secretary of Budget and Management, should likewise be included among the respondents, to the extent that the questioned transfer, budget execution measures, SAROs, NCAs, remittances, or related implementation acts were authorized, approved, initiated, undertaken, or allowed during her tenure as Secretary of Budget and Management,” saad sa reklamo.

Tumutukoy ang SARO sa Special Allotment Release Order, habang Notice of Cash Allocation naman ang NCA.

“Respondent Amenah F. Pangandaman is impleaded only to the extent of acts, approvals, issuances, budget execution measures, or omissions occurring during her tenure as Secretary of Budget and Management,” nakasaad din sa reklamo.

“The inclusion of Respondent Amenah F. Pangandaman is consistent with the allegations of concerted and coordinated governmental action already set forth in the original Verified Complaint, particularly with respect to the implementation and execution of the questioned fund transfer mechanism,” dagdag nito.

Nakipag-ugnayan na ang GMA News Online kay Pangandaman para sa kanyang pahayag at ilalathala ito sa oras na matanggap.

Noong Disyembre ng nakaraang taon, iniutos ng Korte Suprema (SC) sa pamahalaan na ibalik ang P60 bilyong sobrang pondo ng PhilHealth sa pamamagitan ng 2026 General Appropriations Act (GAA).

Sa 136-pahinang desisyon, idineklara ng SC En Banc na walang bisa ang Special Provision 1(d), Chapter XLIII ng 2024 GAA, Finance Circular No. 003-2024, at ang paglilipat ng P60 bilyon dahil umano’y inilabas ito nang may grave abuse of discretion na katumbas ng kawalan o labis na paggamit ng hurisdiksyon.

Nauna nang nagsampa si Leachon ng reklamo laban kina Executive Secretary at dating Finance Secretary Ralph Recto, dating Budget Secretary Rolando Toledo, PhilHealth President at Chief Executive Officer (CEO) Edwin Mercado, dating PhilHealth President at CEO Emmanuel Ledesma Jr., Health Secretary Teodoro “Ted” Herbosa, at PDIC President at CEO Roberto Tan dahil sa umano’y plunder at technical malversation kaugnay ng paglilipat ng P60 bilyong sobrang pondo ng PhilHealth.

Ang pinawalang-bisang special provision ng 2024 GAA ang unang nagtulak sa Department of Finance (DOF), na noon ay pinamumunuan ni Recto, upang maglabas ng circular na nag-uutos sa paglilipat ng P89.9 bilyong pondo ng PhilHealth sa National Treasury.

Nang ilabas ng SC ang desisyon nito, iniutos lamang nito ang pagbabalik ng P60 bilyon dahil iyon lamang ang aktuwal na pondo na nailipat sa National Treasury mula sa kabuuang P89.9 bilyong pondo ng PhilHealth. — FRJ GMA News
