Idineklara ng Commission on Elections (Comelec) Second Division na si Bienvenido “Benny” Abante ang panalong kongresista sa 6th District ng Maynila sa nagdaang Eleksyon 2025 nitong Mayo. Nangyari ito makaraang ibasura ng dibisyon ang kandidatura ng kaniyang nakatunggali dahil sa usapin ng Filipino citizenship. 

Ang pasya ng 2nd division ng Comelec ay tugon sa inihaing petisyon ni Abante na pawalang-bisa ang certificate of candidacy ng nakalaban niyang si Luis “Joey” Chua Uy dahil sa kuwestiyon sa Filipino citizenship ng huli. 

Sa petisyon ni Abante, inakusahan niya si Uy na hindi nito maaaring makuha ang pagiging natural-born citizen "because his father did not have such status at the time of Respondent's birth."

Sakabila ng depensa ni Uy na, "That he is a natural-born citizen of the Philippines and declared the same in his Certificate of Candidacy [COC],"idineklara ng Comelec Second Division na, "he is at most a naturalized citizen, not a natural-born one."

Sa 22-pahinang desisyon ng dibisyon, idineklara si Uy na hindi kandidato at "void ab initio" ang kaniyang certificate of candidacy. 

“Accordingly, the votes cast in his favor are considered stray and should have not been counted,” saad pa sa desisyon. 

“Respondent’s proclamation should thus be annulled leaving petitioner the only qualified candidate who obtained the highest number of votes for the position of member, House of Representatives in the 6th District of the City of Manila,” dagdag nito.

Nanaig ang batas

Sa isang pahayag, sinabi ni Abante na pagsunod sa batas ang naging desisyon ng Comelec.

“This is a victory not just for me and the voters of Manila’s sixth district—but for the Constitution, and the rule of law. The Constitution is clear—only natural-born Filipino citizens are qualified to serve in Congress,” sabi ni Abante, na pinuno ng House Committee on Human Rights sa katatapos lang na 19th Congress sa Kamara de Representantes.

“Our people deserve leaders whose allegiance to the country is beyond question, and whose qualifications are beyond doubt,” dagdag ni Abante. 

Nakasaad sa Section 6, Article 6 ng 1987 Constitution na, “No person shall be a member of the House of Representatives unless he is a natural-born citizen of the Philippines.”

“This is not about personalities—this is about the rule of law. The Constitution must prevail. Our democracy depends on it.” ayon kay Abante.

Hindi pa pinal

Inihayag naman ni Comelec Chairman George Garcia, na hindi pa puwedeng iproklama si Abante bilang nagwaging kongresista hangga't hindi pa pinal ang desisyon sa usapin tungkol sa citizenship ni Uy.

Ayon kay Garcia, may limang araw pa si Uy upang iapela ang desisyon ng Second Division.

“Kahit na anulled ang kaniyang proclamation kung hindi pa final and executory ang decision ay maaring may effect pa ang proclamation hanggat wala pang finality ang decision na binabalewala ang naturang proclamation,” sabi ni Garcia sa mga mamamahayag. 

“Ang laging titingnan ay kapag may inisyu ang Comelec na certificate of finality and entry of judgment. ‘Yun ay nagpapatunay na ang decision namin ay executory na at final,” dagdag pa ng opisyal. —mula sa mga ulat nina Anna Felicia Bajo/Llanesca T. Panti/FRJ, GMA Integrated News
