Ibinasura ng Office of the Ombudsman ang mga kasong treason at espionage laban kina dating Pangulong Benigno Aquino III at Senator Antonio Trillanes IV.

Sa isang resolusyon, iginiit ng Ombudsman na walang basehan ang mga kaso at walang mga ebidensya na magpapatunay na nagsabwatan ang dalawa, salungat sa paratang ng mga nagreklamo.

Sinampahan ng reklamo sina Aquino at Trillanes ng paglabag sa Articles 114, Treason, at 117, Espionage, sa ilalim ng Revised Penal Code.

Isinampa noong Mayo 2016 ang mga reklamo nina Gen. Roberto T. Lastimoso, Dr. Enrico Sampang, Judge Moslemen T. Macarambon, former Congressman Ronald Adamat and Dr. Dioscoro Esteban, Jr. laban kina Aquino at  Trillanes.

Kinwestiyon ng complainants ang "back-channel negotiations" sa mga Tsino na ginawa ni Trillanes sa utos ni Aquino, kaugnay sa gusot sa Scarborough Shoal.

Nakialam umano si Trillanes sa gawain ng Foreign Affairs Department at inilagay sa panganib ang bansa sa pamamagitan ng maling mga impormasyon.

Sa pagbasura sa mga kaso, sinabi ng Ombudsman: "Treason is a war crime. It is not an all-time offense…While there is peace, there are no traitors. There must be actual hostilities…Back-channel negotiations with China cannot be construed as 'giving aid to enemy.'"

Dagdag ng Ombudsman, natural lamang umano para kay Aquino, bilang Pangulo ng bansa, na subukan ang lahat ng paraan upang hindi malagay sa panganib ang bansa.

"As a result of the intense stand-off in April and May 2012 between Chinese and Philippines vessels in the Scarborough Shoal, Pres. Aquino's action of exploring means of peacefully settling the on-going issue with China was for the interest of the Philippines. It is an inherent presidential power to pursue negotiations with other States. On the other hand, Sen. Trillanes merely acted under Pres. Aquino's instruction to negotiate with Chinese representatives in order to ease the escalating tension between the two States."

Nagsimula ang tensyon ng China at Pilipinas noong ika-23 ng Mayo 2011, nang mapag-alamang nagtayo ng military garrison at mga himpilan ang China sa mga bahura at mga isla na kinasasakupan ng Kalayaan Island Group.

Nangyari ang back-channel negotiation noong Mayo 2012.

Katuwiran ng Ombudsman: "The alleged hostilities and aggression in the West Philippine Sea could not, therefore, be attributed to the backchannel discussions between Sen. Trillanes and the Chinese representatives." —LBG, GMA News
