Simula ngayong kalagitnaan ng Nobyembre, ilang kompanya na ang nagsimulang mamigay ng 13th month pay sa kanilang mga empleyado. Gayunman, may mga nagtatanong kung may matatanggap pa rin bang 13th month pay ang mga empleyado na nagbitiw o inalis na empleyado?

Sa Facebook post ng National Wages and Productivity Commission, nakasaad na, "Resigned or separated/terminated employees are also entitled to 13th month pay which is equivalent to proportion of the length of time he/she worked during the year."

Patuloy pa sa post, "That is from the time he started working during the calendar year and up to the time of his resignation or termination from the service."

Batay umano sa Presidential Decree 851, sinabi rin ng NWPC na, "13th Month Pay shall not be less than one-twelfth of the total basic salary earned by an employee in a calendar year."

Dapat daw na maibigay ang 13th month pay sa mga kawani nang hindi lalampas sa December 24 ng taon.

Inihayag din sa isang post ng NWPC na, "13th Month Pay shall be given to all rank-and-file employees regardless of the nature of employment and irrespective of the methods by which wages are paid, and provided they worked for at least one (1) month during the calendar year."

Dahil sa Republic Act 10653, ipinaalala ni Senador Sonny Angaya, chairman ng ways and means committee, na mas malaki na ang makukuhang 13th month pay o Christmas bonus ng mga empleyado dahil libre na buwis ang matatanggap nilang na P82,000.

“Hindi lamang mga regular na empleyado ang dapat makakuha ng 13th month pay. Kahit mga contractual, casual, fixed term, probationary, seasonal employees ay dapat din makatanggap ayon sa ating Labor Code,” ayon pa kay Angara. -- FRJ, GMA News
