Ibinasura ng International Criminal Court (ICC) Pre-Trial Chamber ang apela ng kampo ni dating Pangulong Rodrigo Duterte na alisin ang dalawang hukom sa pagsasagawa ng desisyon tungkol sa hurisdiksiyon ng tribunal sa kinakaharap na reklamong crimes against humanity ng dating presidente.

“A judge’s excusal from the exercise of a function may only be sought by the concerned judge directly before the Presidency, as opposed to disqualification for which the Prosecution or the person being investigated or prosecuted may submit a request before the Presidency. The possibility for that person to invite or request judges to seek excusal before the Presidency is thus not contemplated in the statutory texts,” saad sa apat na pahinang desisyon na pirmado ni Presiding Judge Lulia Antonella Motoc.

“As stated by the Presidency, ‘no preemptive request may be made by the parties that a judge request his or her excusal’ and such course of action ‘lacks procedural propriety’,” dagdag nito.

Inihain ng defense team ang apela noong May 1, at tinutulan naman ng prosekusyon noong May 5.

Hiniling ng kampo ni Duterte ang bahagyang pagliban nina Judge Reine Adélaïde Sophie Alapini-Gansou at Judge María del Socorro Flores Liera kaugnay sa isyu ng hurisdiksyon dahil sa "posibilidad ng pagkiling."

Ipinaliwanag ng depensa na maaaring magmula ito sa naunang paghatol ng mga nasabing hukom sa halos kaparehong isyu kaugnay ng sitwasyon sa Pilipinas.

Sina Motoc, Alapini-Gansou, at Flores Liera ang lumagda sa warrant of arrest laban kay Duterte.

Ayon sa mga abogado ni Duterte, ang mga kinakailangan para sa paggamit ng hurisdiksyon sa sitwasyon sa Pilipinas ay hindi natugunan noong pinahintulutan ng Pre-Trial Chamber ang pagbubukas ng imbestigasyon noong Setyembre 15, 2021.

"The Philippines’ withdrawal from the Rome Statute became effective on 17 March 2019. When the former Prosecutor filed her request, and the Pre-trial Chamber issued its decision, more than two years later," giit ng depensa.

Kasalukuyang nasa kustodiya ng ICC sa The Hague, Netherlands si Duterte.

Gaganapin sa darating na Setyembre 23 ang pagdinig sa kompirmasyon ng mga kaso.

Samantala, nagsumite si ICC Prosecutor Karim Khan ng 139 na ebidensiya na nakaayos sa apat na disclosure packages sa ICC Pre-Trial Chamber 1 noong Abril 30.

Nauna nang sinabi ni Khan na naghanda ang prosekusyon ng dalawang saksi, 16 na oras ng audio at video files, at halos 9,000 pahina ng mga dokumento para sa kumpirmasyon ng mga kaso.— mula sa ulat ni Joahna Lei Casilao/FRJ, GMA Integrated News
