Mananatiling nakadetine si dating Pangulong Rodrigo Duterte sa The Hague, Netherlands matapos tanggihan ng International Criminal Court (ICC) ang hiling ng kaniyang defense counsel na interim release o pansamantalang kalayaan.

Nahaharap si Duterte sa kasong crimes against humanity for murder at attempted murder sa ICC kaugnay sa war on drugs na ipinatupad ng kaniyang administrasyon na nagresulta sa pagkamatay ng mahigit 3,000 tao na sangkot umano sa ilegal na droga.

Sa 23-pahinang desisyon hinggil sa kahilingan para sa pansamantalang pagpapalaya, napagkasunduan ng tatlong mahistrado ng ICC Pre-Trial Chamber I na kailangan ang patuloy na pagdetine kay Duterte "under article 60(2) of the Statute based on each of the requirements set by article 58(1) of the Statute."

Binanggit din sa desisyon ang pagtutol ni Duterte sa kaniyang pag-aresto at pagkakakulong, ang panawagan ng kaniyang pamilya na ibalik siya sa Pilipinas, at ang mga pahayag ng kaniyang anak na babae tungkol sa posibleng pagpapalaya sa dating Pangulo mula sa pagkakakulong sa ICC.

"With regard to the need to ensure Mr Duterte’s presence at trial, the Chamber recalls that Mr Duterte has, from his initial appearance, contested his arrest and detention, qualifying it as a pure and simple kidnapping," anang tribunal.

"In addition, his family not only physically resisted, but also publicly voiced criticism regarding his arrest and detention, and demanded that he should be brought back to the Philippines," dagdag nito.

"More specifically, the Chamber notes that, on 19 July 2025 Mr Duterte’s daughter mentioned in public speeches the idea of breaking Mr Duterte out of the ICC Detention Centre, and attempted to delegitimise the Court’s proceedings against Mr Duterte, citing collusion between the Court and the government of the Philippines as well as the use of ‘fake witnesses,’" ayon pa sa ICC.

Binanggit din ng tribunal na noong ika-19 ng Agosto 2025, ipinahiwatig umano ng anak ni Duterte na sinabi sa kaniya ng dating Pangulo na nais nitong bumalik sa Davao City sakaling pansamantalang palayain siya, na salungat sa pahayag ng depensa na mananatili siya sa bansang kukupkop sa kaniya.
