Idineklara ng House committee on justice na sufficient in form ang dalawang impeachment complaints na isinampa laban kay Vice President Sara Duterte nitong Lunes. Sunod na susuriin ng komite sa Martes kung sufficient in substance naman ang mga reklamo.
Sa isinagawang pagdinig ng komite na pinamunuan ni Batangas Rep. Gerville Luistro, idineklara na sumunod ang ikatlo at ikaapat na impeachment complaint, alinsunod sa naging desisyon noon ng Korte Suprema (SC), na nagsasaad na isang impeachment proceeding lang ang dapat maisampa laban sa isang opisyal kada taon. Dapat na may hindi bababa sa isang endorser mula sa mga miyembro ng Kamara.
Bago ideklarang sapat sa porma ang mga naturang reklamo, nagpasya ang House justice panel na isantabi ang unang impeachment complaint na inihain ng Makabayan coalition at mga kaalyadong grupo noong Pebrero 2 dahil lumabag ito sa one-year bar rule.
"As you have witnessed, a motion was raised by the Honorable [Joel] Chua [of Manila] to resolve first the compliance of the one-year bar rule before we proceed to the determination of sufficiency in substance. And it is the intention of the Justice Committee to include that [compliance in the determination of sufficiency in form because we understand that the one-year prohibition is part of the procedural requirement which must be complied with when filing an impeachment [complaint]," ayon kay Luistro sa press conference ng Day 1 ng pagdinig.
Una rito, inanunsiyo ng Tindig Pilipinas na pormal nilang binawi ang ikalawang impeachment complaint na inihain laban kay Duterte noong Pebrero 2, at nagpasyang suportahan ang ikatlong impeachment complaint.
Sa deliberasyon, sinabi ng ilang mambabatas mula sa oposisyon na impeachable offense ang ginawa umanong tila pagbabanta ni Duterte na ipapapatay si Pangulong Ferdinand Marcos Jr. at ang kaniyang pamilya, gayundin ang umano’y mga inimbento nitong mga pangalan na tumanggap ng confidential funds.
“As to the opinion of some people that there are no “smoking guns” in this and the other complaint, I beg to disagree. The video containing the Vice President’s threat to kill the President, the First Lady and then House Speaker, as well as the media interview where she affirmed it, is a smoking gun,” ayon kay House Deputy Minority Leaders Leila de Lima ng ML party-list, at isa sa mga endorser ng tatlong impeachment complaints.
“The numerous Documents Evidencing Payments (DEPs) with fictitious names are smoking guns. Saballa, et al’s complaint is replete with many other documentary evidence which are also smoking guns,” dagdag niya.
Tinukoy rin ni De Lima ang mga acknowledgement receipts ng confidential fund recipients ng Office of the Vice President at Department of Education noong si Duterte pa ang namumuno rito, na ibunyag sa imbestigasyon ng Kamara hinggil sa paggamit ng budget ng dalawang ahensiya.
Sinabi naman ni Rep. Antonio Tinio ng ACT Teachers party-list, na hindi dapat hayaan na makalusot si Duterte sa mga bogus recipient ng confidential funds.
“Nakakita tayo ng mga ‘dubious accomplishment reports’ at mga pekeng resibo. Sino ang makakalimot kay ‘Mary Grace Piattos’? Isang pangalang hindi matagpuan sa kahit anong rekord ng gobyerno, ngunit ginamit para pirmahan ang paglabas ng pondo ng bayan. Ito ay isang malinaw na panloloko at pambabastos sa proseso ng audit,” giit niya.
“Batay sa mga ebidensyang ito, maliwanag na dapat ma-impeach si Vice President Duterte,” dagdag ni Tinio.
Samantala, sinabi ni Atty. Michael Poa, abogado ni Duterte na hindi na muna sila magkokomento sa resulta ng pagdinig ng komite.
"The Defense Team does not see the need to comment at this point. We will simply continue to monitor the proceedings and provide comments if and when necessary," saad ni Poa sa isang pahayag. — Llanesca T. Panti GMA Integrated News
