Inatasan na ang Philippine National Police (PNP) at ang National Bureau of Investigation (NBI) na arestuhin si Senador Ronald “Bato” Dela Rosa, ayon kay Justice Secretary Fredderick Vida nitong Huwebes.

“I would like to confirm that Philippine law enforcement agencies, which would include the PNP, the NBI, are now tasked to effect the arrest of Senator Bato Dela Rosa,” sabi ni Vida sa isang punong balitaan.

“Senator Bato is a fugitive from justice and he should be brought to the ICC to face the charges,” dagdag niya.

Ayon sa kaniya, alinsunod ito sa "validly issued" na arrest warrant ng International Criminal Court (ICC).

Bukod dito, binanggit ni Vida na wala na si Dela Rosa sa loob ng Senado, ang hindi pag-isyu ng temporary restraining order (TRO) ng Korte Suprema, at ang pagpapatupad ng arrest warrant.

Ipadadala sa ICC?

Gayunman, tumangging sumagot si Vida nang tanungin kung agad na dadalhin si Dela Rosa sa international tribunal, at sinabing "operational matters" ang mga ito.

"These are operational matters that I cannot discuss so that we don't defeat the purpose of the arrest, which is the ultimate objective is to bring him to the ICC," anang kalihim.

Bukod pa rito, may mga lead na umano ang mga awtoridad sa kinaroroonan ni Dela Rosa.

Samantala, nagbabala si Vida sa mga tao na tutumulong kay Dela Rosa para magtago.

“Ang sa akin din pong pakiusap, those who might be aiding, or abetting, or helping Senator Bato evade the law, there are consequences,” aniya.

“Alam natin na sa panuntunan ng rule of law may pananagutan. Hindi lamang po sa… batas ng Pilipinas, pati rin po sa batas ng ICC. Kasi dahil siya ay isang validly issued arrest warrant, diba ng ICC, meron din pong mga panuntunan,” dagdag pa niya.

Pagtanggi sa TRO

Naglabas na ng warrant of arrest ang ICC laban kay Dela Rosa sa gitna ng mga alegasyong kasabwat siya sa mga kasong crime against humanity kaugnay ng mga pagpatay sa giyera kontra droga ni Rodrigo Duterte noong alkalde siya ng Davao City at noong pangulo siya ng Pilipinas.

Iginiit ng legal counsel ni Dela Rosa noong Miyerkoles na bagama't kinikilala nila ang pagkakaroon ng arrest warrant na inisyu ng ICC, hindi nila ito itinuturing na dapat ipatupad sa Pilipinas.

Samantala, tinanggihan ng Korte Suprema ang kahilingan ni Dela Rosa para sa temporary restraining order (TRO) at/o status quo ante order (SQAO) kaugnay ng posibleng pag-aresto sa kaniya batay sa warrant na inisyu ng ICC.

Bagama't nirerespeto ng legal team ni Dela Rosa ang desisyon ng SC, ikinatwiran nitong dapat umiral pa rin ang sariling konstitusyon ng bansa. Sinabi rin ng mga abogado na maghahain sila ng motion for reconsideration.

“We respect the Honorable Court’s action on the application for interim relief. At the same time, it must be emphasized, with equal clarity, that the Supreme Court itself has stated that it acted only on the prayers for provisional relief,” sabi ng The Law Firm of Torreon and Partners, na kumakatawan sa senador, sa isang pahayag.

“The main case remains alive. The constitutional questions remain squarely before the Supreme Court–and those questions are grave: whether the liberty of a Filipino may be placed at the mercy of a foreign process without the intervention of a Philippine court," dagdag pa nito.

'Valid'

Sinabi ng Malacañang nitong Miyerkoles na "valid" ang warrant of arrest na inilabas ng ICC laban kay Dela Rosa.

“Sa ngayon, masasabi po natin na ang warrant of arrest ay valid laban dito kay Senator Bato dela Rosa,” ayon kay Palace Press Officer Usec. Claire Castro sa isang maikling panayam sa mga reporter ng Palasyo.

Samantala, sinabi ni NBI director Melvin Matibag na mayroon na silang lead sa kinaroroonan ni Dela Rosa ngunit tumanggi munang ibunyag ito.

“Ang dami-dami pong lead na binigay but we have a lead kung nasaan talaga pero… in the meantime, we will suspend 'yung announcement kung saan talaga siya," dagdag niya.—Jamil Santos/FRJ GMA News
