Si dating Supreme Court (SC) Associate Justice Andres Reyes Jr., ang mamumuno sa Independent Commission for Infrastructure (ICI), na sisiyasat sa maanomalyang flood control projects, ayon kay Pangulong Ferdinand “Bongbong” Marcos Jr.
Inihayag ito ni Marcos sa press conference sa Kalayaan Hall, nitong Lunes.
''Justice Andy Reyes will be the chairperson of the ICI. He was a presiding judge of the Court of Appeals before. He has been a… for a very, very long time with a very good record of honesty and fairness, and a good record of being able to find justice for those who have been victimized,'' ayon kay Marcos.
Nagretiro si Reyes noong May 2020, ang unang mahistrado na binigyan ng parangal via online sa kaniyang pagreretiro dahil sa panahon ng quarantine at physical distancing dulot ng COVID-19 pandemic.
Naging trial judge siya noong 1987, Court of Appeals justice noong 1999, presiding justice ng appellate court noong 2010, at naging mahistrado ng SC noong 2017, sa panahon ni dating Pangulong Rodrigo Duterte.
Nitong Sabado, tinukoy ng Malacañang na magiging kasapi ng ICI sina dating Public Works Secretary Rogelio "Babes" Singson at Rossana Fajardo, ng auditing firm na SGV and Co.
Itinalaga naman si Baguio City Mayor Benjamin Magalong, bilang special adviser ng komisyon.
Sa ilalim ng Executive Order No. 94, tungkulin ng ICI na, “to investigate and evaluate evidence, intelligence reports, and information, against all government officials and employees, as well as any other individual, involved in anomalies, irregularities, and misuse of funds in the planning, financing, and implementation of government flood control and other infrastructure projects across the country.”
Sakop ng imbestigasyon ng ICI ang mga flood control at iba pang infrastructure projects sa loob ng nakalipas na 10 taon.
Base sa magiging resulta ng imbestigasyon, irerekomenda ng ICI ang civil at administrative cases laban sa mga mapapatunayang may pagkakasala sa anomang para sa nararapat na “disciplinary, prosecutorial, and administrative bodies,” gaya ng Office of the President, Office of the Ombudsman, the Department of Justice, at Civil Service Commission.
Inihayag din ni Marcos na hindi kailangan ng komisyon ang contempt powers.
''So, what the commission will do is that they will investigate, they will call people in, they will subpoena records, they will conduct hearings and once they have their findings, they will forward those findings to the proper agency – should it be the Ombudsman, should it be the DOJ; if it's an administrative case by government employees, sa Civil Service Commission and all of the proper agencies, doon na sila magrekomenda,'' saad ng pangulo.
''And, if such personalities continue to avoid or not cooperate with the Ombudsman or the DOJ, doon sila mako-contempt. So, we do not lose that power and capability to hold people in contempt should they not cooperate, should they not respect subpoenas etcetera,'' dagdag niya.
Kung bakit 10 taon ang sakop ng imbestigasyon ng komisyon, paliwanag ni Marcos, ''The practical answer is this: COA is only required to keep records for 10 years. So, those are the records that we know we have na nakakasiguro tayo na matutulungan iyon,'' ayon kay Marcos.
''Pangalawa doon kaya we’ll do it for as long as possible dahil marami na tayong napag-usapan at isa sa napakahalaga para sa akin ay malaman paano tayo napunta sa ganito? Bakit nagkaganito iyong gobyerno natin? Papaano nangyari ito na ganito iyong naging bidding? Papaano nangyari na ganito ang naging pagbigay ng kontrata?
