Panunumpain ang mga bagong senador na magsisilbing mga hukom sa impeachment trial ni Vice President Sara Duterte, kapag nagsimula na ang 20th Congress at naihalal na ang bagong Senate President, ayon sa Senate impeachment court spokesperson na si Atty. Regie Tongol.
Tugon ito ni Tongol sa panawagan ni Senador Risa Hontiveros, kay Senate President Francis “Chiz” Escudero, ang presiding officer ng impeachment court, na panumpain na ang mga bagong senator-judge.
Ayon kay Tongol, ang panunumpa ng mga bagong senator-judge ay nakadepende sa presiding officer o sa Senate president.
Dahil papasok pa lang ang bagong 20th Congress, maaari umanong manatiling Senate President si Escudero, at maaari din namang mapalitan.
“[The] senator-judges will have to take their oath before the presiding officer. And as you know, if one Congress adjourns and another begins, the Senate president is going to be elected or reelected again, so kailangan po nating hintayin kung kanino manunumpa,” sabi ni Tongol.
“Ayaw po ng presiding officer na magkaroon ng kuwestiyon doon sa proseso o sa step na ‘yun ng panunumpa na maaari pang makuwestiyon at magkaroon ng legal impediments kapag nagpatuloy na ang proseso. So gusto ng presiding officer, as a matter of prudence and diligence, na gawin na lamang ‘yun kapag nag-elect ng Senate president,” dagdag niya.
Ayon kay Tongol, ang pinakamaagang araw na maaaring gawin ang panunumpa sa mga bagong senator-judge ay sa July 29—isang araw matapos ang pagbubukas ng 20th Congress sa July 28, na araw din na gaganapin ang ikaapat na State of the Nation Address (SONA) ni Pangulong Ferdinand “Bongbong” Marcos Jr.
Sa ngayon, sinabi ni Tongol na nananatiling impeachment court presiding officer si Escudero alinsunod sa “holdover principle.”
Kasabay nito, pinawi ni Tongol ang pangamba ni House prosecutor at Akbayan Rep. Chel Diokno na baka “trap” ang gagawing pagsagot ng Kamara sa isa pang hinihinging sertipikasyon ng impeachment court tungkol sa impeachment trial ni Duterte.
“This certification procedure should not be seen as traps or measures to impede, but these certification processes help prevent any legal impediment or challenges or technicalities that could undermine the impeachment process once it starts rolling and to uphold the proceeding’s integrity,” paliwanag ni Tongol.
