Sinabi ni Senador Francis “Chiz” Escudero, ang nahalal na presiding officer ng Senado na tatayong impeachment court, na 16 na boto ng mga senador na magsisilbing hukom, ang kailangan kung hahatulan na guilty sa impeachment trial si Vice President Sara Duterte.

Sa kaniyang mensahe matapos tanggapin ang posisyon bilang presiding officer ng impeachment court nitong Lunes, iginiit ni Escudero na malinaw na nakasaad sa Konstitusyon na walang sinuman ang maaaring mahatulan nang walang pagsang-ayon ng of two-thirds ng lahat o 24 na miyembro ng Senado.

Inilahad ito ni Escudero kasunod ng pagkakaaresto kay Senador Rodante Marcoleta ngayong Lunes para sa kasong plunder dahil sa pagtanggap niya ng P75 milyong campaign contribution na hindi niya idineklara.

Ilang linggo na ang nakararaan nang arestuhin din si Senador Jinggoy Estrada kaugnay ng kasong plunder tungkol sa flood control projects. Samantala, nagtatago naman si Senador Ronald “Bato” Dela Rosa, na may warrant of arrest mula sa International Criminal Court (ICC)

“With 24 members of the Senate, a literal interpretation of this means that conviction requires the affirmative vote of at least 16 senator-judges,” ayon kay Escudero.

Ayon kay Escudero, sinusuportahan ang interpretasyong ito ng desisyon ng Korte Suprema sa kasong Bayan v. Zamora noong 2000, na tumalakay sa kinakailangan ng two-thirds vote ng Senado para sa pagpapatibay ng isang tratado.

Ipinaalala niya na 23 lamang ang nanunungkulang senador noong panahong nahalal si Gloria Macapagal-Arroyo bilang bise presidente.

“The Court held: The charter provides that the Senate shall be composed of 24 senators; without a tinge of doubt, two-thirds of the figure or not less than 16 members is an unquestionable compliance with the requisite number of votes mentioned in Section 21 of Article 7,” ani Escudero.

“It behooves therefore all of us to observe the same fidelity with the Constitution in this trial, which affects not only the mere ratification of a treaty, but more so affects the substantial rights of the respondent, as well as the sovereign will of the people as expressed in the overwhelming mandate given to her,” dagdag niya..

Binigyang-diin ni Escudero na dapat sundin ng lahat ng senador na hukom ang umiiral na batas, sang-ayon man sila o hindi.

“This is the prevailing law today. And whether we agree with it or not, we must abide by it,” dagdag niya.

Una rito, nahalal si Escudero bilang presiding officer ng impeachment trial ni Duterte nitong Lunes ng hapon sa boto ng 12 na mga senador, at walo ang tutol.

Nauna na rin niyang pinamunuan ang impeachment court noong 2025 habang siya pa ang Senate President.

Pinaalalahanan din ni Escudero ang kanyang mga kapwa senador na pairalin ang patas at walang kinikilingang paghatol alinsunod sa Konstitusyon at sa mga umiiral na batas.
