Hinikayat nina Senator Alan Peter Cayetano at walo pang mga senador nitong Martes ang Korte Suprema na ideklarang “null and void” ang sesyon noong Hunyo 3, kung saan inihalal si Senator Sherwin Gatchalian bilang Senate President Pro-Tempore.

Sa 86 na pahinang petition for certiorari, hiniling din nina Cayetano, at mga senador na sina Loren Legarda, Pia Cayetano, Jinggoy Estrada, Bong Go, Rodante Marcoleta, Imee Marcos, Robin Padilla, at Camille Villar ang Korte Suprema na mag-isyu ng status quo ante order "reverting the Parties and the conditions prior to the questioned proceedings starting June 3, 2026."

Kasama rin sa mga petitioner si Atty. Jose Luis Montales, ang Senate secretary sa ilalim ni Cayetano.

Hinimok din ng mga petitioner ang mataas na hukuman na ideklarang “null and void” ang quorum sa sesyon noong Hunyo 3, ang pag-apruba sa mosyon ng pagbabakante sa mga posisyon sa Senado, pagpapatibay ng isang resolusyon sa sine die adjournment, at "all other acts, elections, and designations of respondent senators emanating from the void session and false constitution of a supposed quorum."

Hiniling din nila sa SC na, "immediately cease and desist" ang Gatchalian bloc sa paggigiit at pagganap ng kanilang mga tungkulin sa opisina na sinimulan nilang upuan noong Hunyo 3.

Kabilang dito ang paghalal kay retiradong Police Major General Alfredo Corpus bilang Senate Sergeant-at-Arms, kay Atty. Renato Bantug bilang Senate Secretary, kay Senador Juan Miguel Zubiri bilang majority leader, at ang pagtatalaga ng mga chairpersonship ng komite.

Kung mapagbibigyan, hinihiling ng mga petitioner sa SC na ibalik at ideklara si Cayetano bilang Senate President, si Legarda bilang Senate President Pro Tempore, si Montales bilang Senate secretary, at lahat ng chairperson ng mga komite ng Senado bago ang Hunyo 3.

"Petitioners sought judicial intervention at the earliest practicable opportunity after the occurrence of the challenged acts. This prompt resort to the Honorable Court reflects neither haste nor speculation, but recognition of the substantial constitutional consequences that would inevitably follow if the controversy were left unresolved while the disputed actions continued to operate," ayon sa kanila.

Ayon pa sa kanila, ang issue "could generate consequences beyond meaningful judicial correction."

Dagdag pa nila, kritikal ang oras ng petisyon dahil nagsisilbing pundasyon ang korum para sa isang serye ng mga aksyon na nakaaapekto sa pamumuno sa Senado, organisasyon ng mga komite, mga imbestigasyon sa lehislatura, at mga proseso ng impeachment.

"By seeking relief at the outset, petitioners have afforded the Honorable Court the opportunity to the constitutional matters involved before they are further overtaken by events," sabi nila.

Sa isang post sa social media, sinabi ni Alan Cayetano na hindi tungkol sa isyu ng pamumuno sa Senado ang petisyon, kundi sa pangangalaga ng mga institusyon.

"Those who oppose it want to paint our motives in those simple terms—simple enough to twist, simple enough to confuse people about the real issues. Let me reiterate what we have said from the start: leadership positions are temporary stewardship. Leaders holding high government positions come and go. Political alliances change. Majorities rise and fall," sabi niya.
