Kulang ang isinumiteng documentary evidence ng tanggapan ni Vice President Sara Duterte para sa mga pagbabayad sa mga recipient ng hindi bababa sa P129 milyon mula sa P250-milyong alokasyon ng confidential fund para sa una at ikalawang quarter ng 2023, ayon sa isang saksi mula sa Commission on Audit (COA) nitong Martes.
Nagbigay ng testimonya ang abogadong si Roderick Wamil, isang dating state auditor ng COA - Intelligence and Confidential Funds Audit Office (COA-ICFAO), bilang saksi para sa prosekusyon sa ika-12 araw ng impeachment trial ni Duterte.
"For the accomplishment report for the period February 6 to March 29, 2023 on provision for medical and food aid [using confidential funds], the OVP spent P42 million. Based on the accomplishment report for April 25 to June 30, 2023, the office spent money for the provision of medicine and food, amounting to P40 million and P82 million. No attachments were provided," sabi ni Wamil sa magkahalong Ingles at Filipino, nang tanungin ng private prosecutor na si Lorna Kapunan kung nagsumite ang OVP ng anumang mga dokumento na nagpapakita na ginawa ang mga bayad para sa medical o food supplies.
Sinabi ni Wamil na ginamit ng OVP ang P15 milyon ng confidential funds nito bilang bayad sa mga gantimpala mula Pebrero 6 hanggang Marso 29, habang ginamit din bilang bayad sa mga gantimpala mula Abril 25 hanggang Hunyo 30, 2023 ang isa pang P12 milyon.
"Our findings or observations include, first the OVP did not submit documentary evidence of payments [for the recipient of its confidential funds] for the 1st and 2nd quarters of 2023. Secondly, based on their accomplishment report, payment of rewards is indicated, but the the OVP did not submit any document evidencing the success [of gathering information], which is in violation of the Item 4.8.5 of the 2015 Joint Circular," sinabi rin ni Wamil sa pinaghalong Ingles at Filipino, na tinutukoy ang isang 2015 Joint Circular na namamahala sa paggamit ng mga confidential at intelligence funds.
"The Item 4.8.5 of the Joint Circular requires documents evidencing the success of the information gathering or surveillance activities. But since the OVP did not submit those documents, (the payment of rewards did not comply with the requirements) of the Joint Circular. What we are looking for is that there should be causal link between successful surveillance activity or information gathering and the information given by the informer as required by the Joint Circular," sabi ni Wamil.
Sinabi rin ni Wamil sa Senate impeachment court na hindi nagsumite ang OVP ng documentary evidence kung saan ginamit isa pang P20 milyong halaga ng confidential funds na ipinamahagi sa dalawang batch mula Pebrero 6 hanggang Marso 29, 2023 at Abril 25 hanggang Hunyo 30, 2023, para sa mga insentibo sa travel kaugnay ng mga confidential na operasyon.
"There were no attachments [of documents] submitted by the OVP," sabi ni Wamil nang tanungin ni Kapunan kung nagsumite ang OVP ng mga resibo o anumang kalakip para patunayan na naglabas ito ng P20 milyon para sa nilalayon nitong adhikain.
Dagdag pa rito, sinabi ni Wamil na ginamit din ng OVP ang alokasyon ng confidential fund nito noong 2023 para sa una at ikalawang quarter sa pagbili ng tulong medikal at pagkain at pagbabayad ng mga insentibo para sa paglalakbay kaugnay ng mga confidential operation.
"These do not fall among those enumerated under item 4.8 of the 2015 Joint Circular [where the confidential fund should be used]. Thus, the same should not be charged against the confidential fund of the agency," pahayag nito.
Sinabi ni Wamil na nakatanggap ang OVP ng P125 milyong halaga ng confidential fund para sa unang quarter ng 2023, at isa pang P125 milyong confidential fund para sa ikalawang quarter ng 2023.
Bukod pa rito, nagpatotoo si Wamil na may isa pang P125 milyong confidential fund para sa ikatlong quarter ng 2023, bagama't hindi pinayagan ng Senate impeachment court si Wamil na tumestigo sa alokasyon para sa ikatlong quarter dahil wala na siya sa ICFAO unit ng COA nang matapos ang audit ng P125 milyong confidential fund allocation para sa ikatlong quarter.
Isang testigo si Wamil ng prosekusyon para sa Artikulo 1, na nag-aakusa sa Ikalawang Pangulo ng impeachable offenses dahil sa sistematiko, maling paggamit, at iregular na paggamit ng mga confidential fund na nagkakahalaga ng P500 milyong inilabas sa OVP at P112.5 milyong inilabas sa Department of Education (DepEd) noong nanunungkulan siya bilang kalihim ng Edukasyon. —Jamil Santos/AOL GMA News
