Pinayuhan ni House justice committee chairperson at Batangas Representative Gerville Luistro si Sagip party-list Representative Paolo Marcoleta, na dalhin sa Korte Suprema (SC) ang mga katanungan nito tungkol sa legalidad ng ginagawang pagdinig ng komite sa impeachment complaint laban kay Vice President Sara Duterte.
Nag-ugat ang diskusyon nina Luistro at Marcoleta sa mga negatibong komento ng huli tungkol sa pagsisiwalat ng Statement of Assets, Liabilities and Net Worth (SALN) ni Duterte sa impeachment proceedings ng komite para sa pagtukoy ng probable cause tungkol sa reklamo.
Inakusahan ni Marcoleta ang komite na nagsasagawa ng “fishing expedition” matapos lumabas sa pagdinig na hindi nagdeklara si Duterte ng anumang cash in hand o in bank mula 2019 hanggang 2024 batay sa kaniyang mga record ng SALN na isinumite ng Office of the Ombudsman.
Ikinatwiran ni Marcoleta na hindi kasama sa impeachment complaints ang mga SALN ni Duterte, at nakuha lamang ng komite ang impormasyon sa pamamagitan ng pag-isyu ng subpoena sa Office of the Ombudsman.
“This [impeachment] complaint is just requesting the committee to produce evidence. This means there is no evidence, and the complainant appealed to the committee to produce the evidence that was not attached in the original complaint,” paliwanag ni Marcoleta.
Tiniyak naman ni Luistro kay Marcoleta na ang pag-isyu ng subpoena ng House justice panel para sa pagkuha ng mga SALN ay nakabatay sa mga patakaran ng House impeachment, sa Konstitusyon, at sa desisyon ng SC sa kasong impeachment noong 2024, na isinampa rin laban sa bise presidente.
“The purpose of the compulsory process [of issuing a subpoena] of the House justice committee is for the purpose of testing the sufficiency of the allegations, whether the same constitute probable cause which [determination] is the mandate of this Committee. So, with due respect to Honorable Marcoleta, it is our humble position that all the actions of this committee, including the issuance of subpoena of all these questions, by Your Honor, is in accordance with the rules of impeachment, the Constitution, and even with the decisions of the Honorable Supreme Court,” sabi ni Luistro.
Tugon naman ni Marcoleta, “the court will be the better judge of that.”
At sinagot naman ni Luistro na: “And that is why you should elevate them to the Honorable Court.”
Gayunpaman, hindi nagpahayag ng interes si Marcoleta na kuwestiyunin sa SC ang isinasagawang proseso ng komite sa pagdinig ng komite sa impeachment complaint.
“Maybe not me, but some other parties. Thank you, Madam Chair,” saad ni Marcoleta.
